CRIMINAL PENALTIES FOR DWI

First DWI offense within 10 years .19 or under (MISDEMEANOR) 0-90 days incarceration
First offense within 10 years but .20 or more and/or child endangerment or Test Refusal (GROSS MISDEMEANOR) 0- 365 days incarceration
Second offense within 10 years (GM) 30 - 365 days incarceration
Third offense within 10 years (GM): 90-365 days incarceration
Fourth offense within 10 years (FELONY)

180 days - 3 years incarceration

5th offense or more within 10 years (FELONY)

365 days - 3 years incarceration

DRIVERS LICENSE PENALTIES:

First offense within ten years 90 day Revocation
Second offense within ten years: 180 day Revocation
Third offense within 10 years: One year Revocation
Four or more offenses within ten Two year Revocation

LICENSE PLATE PENALTIES:

Impoundment if second incident within ten years or .20 or more or child endangerment

VEHICLE FORFEITURE

A vehicle may be seized if DWI conviction with two aggravating factors present, i.e. prior convictions within 10 years, .20 or more, or child endangerment.

CDL HOLDERS:

The legal limit in a commercial motor vehicle is .04.

A driver convicted of DWI or Refusal to Test will be disqualified from operating a commercial motor vehicle (CMV) for one (1) year - even if the incident occurs in a private vehicle.

A driver convicted of a 2nd DWI or Refusal to Test will be disqualified from operating a CMV for life - even if the incident occurs in a private vehicle.
